102074315 Saskatchewan Ltd. and its subsidiaries, representatives, affiliates, officers, directors, employees, agents, and assigns employees, agents, and assigns (collectively, “K-Go”, “we” or “us”) respects an individual’s privacy and values the privacy of individuals who use our application, websites and related K-Go Platform (collectively, the “K-Go Platform”). We will only collect, use or disclose your personally identifiable information (“Personal Information”) in accordance with this privacy policy (the “Privacy Policy”).
This Privacy Policy explains how we collect, use, disclose, retain and protect Personal Information of K-Go users (“Users”), comprised of both K-Go riders and guardians (respectively, “Riders” or “Guardians”) and K-Go drivers including driver applicants (“Drivers”) and information within the framework of our activities, in particular in connection your use of the K-Go Platform. Your use of the K-Go Platform is also subject to our Terms of Service (www.K-Go.com/terms).
This Privacy Policy does not apply to any third-party websites, services or applications, even if they are accessible through our K-Go Platform. Any information that we collect is subject to the Privacy Policy in effect at the time that information is collected. K-Go may, however, modify and revise this Privacy Policy from time to time. If K-Go make any material changes to this Privacy Policy, K-Go will notify Users of those changes by posting them on the K-Go Platform or by sending Users an email or other notification, and K-Go will indicate when those changes will become effective. Also, please note that, unless K-Go define a term in this Privacy Policy, all capitalized words used in this Privacy Policy have the same meanings as in our Terms of Service.
By supplying Personal Information to us, you agree to this Privacy Policy.
PERSONAL INFORMATION WE COLLECT
Information Provided Directly by User
K-Go collects information that our Users provide directly to us over the web, mobile app, email, phone call or text or in person. This information can be collected during various interactions such as when user creates or modifies their Account, request on-demand services, contact customer support, or otherwise communicate with us directly or indirectly. This information may include: name, email, phone number, postal address, profile picture, payment method, service notes, and other information user choose to provide about self or User’s family, friends and social network (such as about User’s connections, User’s kids’ school or activity centers/staff, neighbors and their families, etc).
User Feedback: At K-Go, we want to make sure Users are always enjoying great rides. When the feature is available, Guardians or Riders and Drivers may rate and review each other at the end of every ride. We receive information about ratings and reviews and, as we explain below, give Guardians information about Drivers’ ratings and reviews and vice versa.
Information Collected from User’s Use of the K-Go Platform
When User use our K-Go Platform, K-Go collects information about the User in the following ways:
Location Information: When a User uses the K-Go Platform, K-Go collect precise location data about the rides and services from the K-Go Platform. If a User permits the K-Go Platform to access location services through the permission system used by User’s mobile operating system, K-Go may also collect the precise location of User’s device when the K-Go Platform is running in the foreground or background. K-Go may also derive User’s approximate location from User’s IP address. If you label certain locations, such as “home” and “work,” we receive that information too.
Your location information is necessary for the following services offered under the K-Go Platform:
Contacts Information: If user permit the K-Go Platform to access the address book on User’s device through the permission system used by User’s mobile platform, K-Go Platform may access and store names and contact information from User’s address book to facilitate invitations to other Guardians for Carpool ride booking or social interactions through our K-Go Platform and for other purposes described in this Privacy Policy or at the time of consent or collection.
Transaction Information: K-Go collects transaction details related to User’s use of our K-Go Platform, including the type of service requested, date and time the service was provided, amount charged, distance traveled, and other related transaction details. Additionally, if someone uses User’s promo code, K-Go may associate User’s name with that person.
Usage and Preference Information: K-Go collect information about how User interact with the K-Go Platform, preferences expressed, and settings chosen. In some cases K-Go does this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers. This information allows us to understand how you use the K-Go Platform and helps us to improve.
Device Information: K-Go may collect information about user’s mobile device, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information. We collect mobile sensor data from Drivers’ devices (such as speed and direction) to improve location accuracy, analyze usage patterns, and to optimize the K-Go Platform functionality.
Call and SMS Data: We work with a third party partner to facilitate phone calls and text messages between Guardians and Drivers who have been connected for a ride. We receive information about these communications including the date and time of the call or SMS message, the parties’ phone numbers, and the content of any SMS messages. When the feature is available, for security purposes, we may also monitor and/or record the contents of phone calls made on the K-Go Platform, such as those between Guardians and Drivers. When the feature is available, for security purposes you will be given notice that your call may be recorded, and by proceeding you agree to allow us to monitor and/or record your call.
Log Information: When user interact with the K-Go Platform, K-Go collects server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service user were using before interacting with our K-Go Platform.
We also employ software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. This software receives and records the Internet Protocol (IP) address of the computer that has contacted and/or used the K-Go Platform, the date and time of the visit and the pages visited. We make no attempt to link these addresses with the identity of individuals visiting and/or using the K-Go Platform unless an attempt to damage the K-Go Platform has been detected.
Information Collected from Other Sources
K-Go may also receive information from other sources and combine that with information K-Go collects through the K-Go Platform. For example:
Information Collected from Third Parties: If you choose to link your K-Go account with a third party’s service, we may receive the same type of information we collect from you from those third parties. We may receive additional information about you, such as demographic data, payment information, or fraud detection information, from third party partners and combine it with other information that we have about you. K-Go works with third party partners to perform driving record and criminal background checks on Drivers, and we receive information from them such as publicly available information about a Driver’s driving record, criminal record, including a vulnerable sector check within such criminal record.
If User choose to link, create, or log in to User’s Account with a payment provider (e.g., Google Wallet) or social media service (e.g., Facebook), or if User engage with a separate app or website that uses our API (or whose API K-Go uses), K-Go may receive information about User or User’s connections from that site or app.
If User’s affiliation uses one of our enterprise solutions, K-Go may receive information about User from User’s affiliate (affiliate can be User’s employee, school, activity centers, etc).
HOW WE USE YOUR PERSONAL INFORMATION
We use personal information for the purposes stated or implied at the time of collection, including for the following purposes:
We may otherwise use your personal information where permissible by law, for example to respond to an emergency, to meet the legal and regulatory requirements applicable to us, where we may be asked or required by certain governmental entities to report certain information about Drivers and Users, or in the course of an investigation into illegal behavior. We will never rent, lease, sell or barter your information to anyone or any organization without first obtaining your explicit consent to do so. Also, if the need ever arises, we may use and share location information to help protect the safety of Users or the public.
HOW WE SHARE YOUR PERSONAL INFORMATION
K-Go may share the information K-Go collects about Users as described in this Privacy Policy or as described at the time of collection or sharing, including as follows:
Sharing between Users: In order to enable identification and safe ride processes when Riders are picked up and dropped off, when Users have been matched for a Ride are able to see basic information about each other, such as the following:
Sharing as Authorized by User: with other people, as directed by User, such as when User want to share User’s estimated time of arrival or split a fare.
Sharing with Third-Parties: to provide user a service user requested through a partnership or promotional offering made by a third party or us or with whom User chooses to let us share information, for example other apps or websites that integrate with our API or Services, or those with an API or Service with which K-Go integrates.
Sharing with User’s Affiliates: such as User’s employee, school, activity centers, etc.) and any necessary third-parties engaged by us or User’s affiliates, if User participate in any of our enterprise solutions (if offered).
Sharing with the General Public: if User submit content in a public forum, such as blog comments, social media posts, or other features of our K-Go Platform that are viewable by the general public.

CONSENT
Privacy legislation requires that we obtain the consent of an individual for the collection, use or disclosure of Personal Information in many circumstances. By providing your Personal Information to us, you agree that we may collect, use and disclose your Personal Information in accordance with this Privacy Policy and as otherwise permitted or required by law, and that we may access, process and store your Personal Information in Canada or another jurisdiction.
When we receive Personal Information from you for the purposes of providing you with the K-Go Platform, or for other uses identified herein, you are providing us with consent as follows:
If you need to provide us with Personal Information about other individuals, you represent and warrant to us that, where required by law and prior to your disclosure to us, you will obtain the consent of each individual to the collection, use and disclosure by us for the specific purpose(s) that the disclosure is made by you.
Providing us with your Personal Information is always your choice. When you utilize our K-Go Platform, we ask that you provide information that enables us to respond to your request. In doing so, you consent to our collection, use and disclosure to appropriate third parties of such Personal Information for these purposes. If we sell our organization or merge with another party, your consent will be implied to transfer your information to our successor for the same purposes as set out in this Privacy Policy.
You hereby expressly consent to K-Go’s use of location-based services and expressly waive and release K-Go from any and all liability, claims, causes of action or damages arising from your use of the K-Go Platform, or in any way relating to the use of the precise location and other location-based services.
Consent Exceptions
There are legal exceptions where we will not need to obtain consent or explain the purposes for the collection, use or disclosure of Personal Information. Some examples of situations where consent is not required include an emergency that threatens the life, health or security of an individual, or if we must comply with a court order or governmental order.
YOUR CHOICES
Email Subscriptions. You can always unsubscribe from our commercial or promotional emails but we will still send you transactional and relational emails about your account use of the K-Go Platform. Despite your indicated email preferences, we may send you service related communications, including notices of any updates to our Terms of Service or this Privacy Policy, which you may not opt out of and which we are legally permitted to send.
Text Messages. You may opt out of receiving all texts from K-Go (including transactional or relational messages) by opting out of texts in the Profile section of the K-Go Platform. However, opting out of receiving all texts may impact your use of the K-Go Platform. Drivers can also opt out of driver-specific messages by texting STOP in response to a driver SMS. To re-enable texts you can text START in response to an unsubscribe confirmation SMS.
Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact your use of the K-Go Platform (such as receiving a notification that your ride has arrived).
Profile Information. While your name will always be shared with Users you can delete any additional information that you added to your Profile at any time if you don’t want Users to see it. Guardians or Riders will always be able to see Drivers’ names, rating, profile photo, and vehicle information.
Location Information. While you can prevent your device from sharing location information at any time through your device’s operating system settings, Rider and Driver location is core to the K-Go Platform and without it we can’t provide the K-Go Platform to you.
Editing and Accessing Your Information. You can review and edit certain account information by logging in to your account settings and profile. Drivers may edit additional information through the Driver portal. If you would like to terminate your Account, please contact us with your request. Please note that in some cases K-Go may retain certain information about Users as required by law, or for legitimate business purposes to the extent permitted by law. For instance, if Users have a standing credit or debt on User’s Account, or if K-Go believe Users have committed fraud or violated our Terms of Service, K-Go may seek to resolve the issue before deleting User’s information.
Limited Collection, Use, Disclosure and Retention
We will only collect such information that is deemed necessary to meet the purpose for which such Personal Information is collected.
We will only use your Personal Information in accordance with this Privacy Policy. If in the course of managing its business operations, we share your Personal Information with professional advisors, franchisees, suppliers, any such entities shall be required to comply with privacy guidelines that impose obligations at least commensurate with this Privacy Policy. We do not sell or disclose Personal Information to third parties, other than in compliance with this Privacy Policy and as required to satisfy any law, regulation, legal request, to protect its business interests, and to co-operate with any law enforcement investigation or on matters concerning public policy and safety.
If we have already disclosed some of such Personal Information to third parties, we cannot access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures. Certain information is necessary in order for us to provide the K-Go Platform; therefore, if you delete such necessary information you may not be able to access the K-Go Platform.
Collection of additional Personal Information through the K-Go Platform
As part of the use of the K-Go Platform online, K-Go may collect additional Personal Information (“Online Information”) about the use of the K-Go Platform, and this Privacy Policy applies to this Online Information with the appropriate adjustments. General information, such as demographic statistics about Users, the number of Users and the average time of use of the K-Go Platform, is likewise considered Online Information.
K-Go collects or obtains Online Information as part of the operation of the K-Go Platform. For example, when a User decides to use the K-Go Platform, K-Go may automatically collect information obtained by way of analytical tools or digital markers. These analytical tools collect only a limited dataset, in particular the time and date when a service was used and the IP address. A service may also contain analytical tools placed by advertising partners or service providers in order to allow us to evaluate the effectiveness of the K-Go Platform, including Google Analytics, Google Marketing Services and Google Ad Manager.
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses Online Information collected to track the use of the K-Go Platform and to personalize ads. You can opt-out of having your Online Information being used by Google Analytics for example by installing the Google Analytics opt-out browser add-on available at: https://tools.google.com/dlpage/gaoptout.

In addition to what is already provided in this Privacy Policy in regard to Personal Information, we use Online Information to track the use of the K-Go Platform and improve their use, customize the experience of the Users, in particular by proposing customized advertisements and offers, make statistical analyses of all the characteristics and behaviours of Users, measure the demographic variables and interests of Users with respect to specific K-Go Platform, describe its K-Go Platform to third parties and potential commercial partners and determine how and where K-Go resources can be allocated more effectively. No Personal Information is disclosed as part of such activities. This Online Information is necessary for us to be able to collect the data required to record the number of Users, the functionalities or aspects of the K-Go Platform most used, the technology used by the Users of the K-Go Platform, the referral websites and the location of the Users.
Cookies
K-Go may occasionally use cookies to track how its visitors use the K-Go Platform or to determine the website previously visited. Cookies are fragments of information sent to Users’ computer when a website is viewed. These are traces of the Users’ visits that are recorded either temporarily or permanently on their hard drive and may include the date and time of the last visit, among other things. Cookies contribute to improving Users’ online experience by recording browsing preferences on a particular website. The K-Go Platform will notify you before any cookies are used, so that you may refuse them. A refusal of cookies will not affect the K-Go Platform performance or restrict a User’s ability to access information on the K-Go Platform.
Cookies left on Users’ hard drive are harmless and may be read or deleted at any time. Users therefore have complete control over them. The information allows K-Go to determine the total number of visitors to each web page and the time spent on it. Every time Users go to a website, a cookie is created and left on their computer, therefore allowing the K-Go to “recognize” them.
The K-Go Platform may use retargeting services (for example Google Analytics) to identify Users who have used the K-Go Platform and reach them with online advertising once they have stopped using the K-Go Platform, in order to transmit advertisements associated with prior use of the K-Go Platform, without however disclosing any Personal Information in doing so.
Third Party Links
The K-Go Platform may contain links to other websites operated by third parties. Please note that this Privacy Policy applies only to the Personal Information that we collect or receive from third parties with your consent and we cannot be responsible for personal information that third parties may collect, store and use, including through their websites. You should always read the privacy policy of each website you visit carefully.
Cloud Based Servers
We process and store Personal Information using our server(s) based in Canada but, on occasion, may also use cloud service providers. In such instances, we have ensured that our cloud service providers are bound to maintain the Personal Data in accordance with this Privacy Policy. By accepting this Privacy Policy or using the K-Go Platform, you agree to the transfer of any Personal Information that you provide to such cloud based servers.
Children
We take special precautions to comply with applicable laws regarding children’s advertising and privacy. The K-Go Platform are not for children, We do not intend to collect Personal Information from children without verified parental consent or in any other way not allowed by law. If you think we have done this, please let us know.
Access and Correction
We recognize that you may have the right to access your Personal Information. Any access request must be made to the Privacy Officer whose contact details are set out below.
We may charge a reasonable fee for providing information in response to an access request, and, upon request, we will provide an estimate of any such fee upon receiving a request to access information. We may require a deposit for all or part of the fee.
Where applicable or permitted, we will make the information available within a reasonable time period or provide written notice when we require additional time to respond to a request for access to information.
In some situations, we may not be able to provide access to certain Personal Information as the right to access personal information is not absolute. If we do not provide you with the requested information, we will notify you in writing and explain our reason(s) for not fulfilling your request.
Questions, comments, suggestions or complaints
For any questions, comments or suggestions regarding this Privacy Policy or the Personal Information protection practices of the K-Go not discussed in this Privacy Policy, you can write to K-Go’s Privacy Officer by email or regular mail at the coordinates below. You can submit complaints to the K-Go’s Privacy Officer if you think that the K-Go is not meeting its obligations with respect to the protection of Personal Information. We will investigate such complaints and if they are justified, will take appropriate measures to correct the situation. If you are not satisfied with this internal review of your complaint, you can contact the Office of the Privacy Commissioner of Canada.
We may change this Policy from time to time. Laws, regulations and industry standards evolve, which may make those changes necessary, or we may make changes to our business. We will post the changes to this page and encourage you to review our Privacy Policy to stay informed. If we make changes that materially alter your privacy rights, we will provide additional notice, such as via email or through the Platform. If you disagree with the changes to this Privacy Policy, you should stop using the K-Go Platform.
Contact Us
If Users have any questions about this Privacy Policy, or have a request that we delete their Personal Information from our systems, or want to request access or correction to their Personal Information, we will attempt to accommodate such requests to the extent possible. If all such information is deleted from our systems, your Account may become deactivated. In any event, we may retain an archived copy of your records as required by law or for legitimate business purposes.
